  4. Transaction Limit: A transaction limit sets the maximum amount of money that can be sent or received in a single transaction.   5. Chargeback: A chargeback occurs when a customer disputes a charge from a merchant and the transaction amount is returned to the customer's account.   6. Encryption: Encryption is a security measure that involves encoding payment information into a secure format during transmission.   8. Authorization Hold: An authorization hold is a temporary withhold of funds in a customer's account, pending the final processing of a transaction.   9. Payout: A payout refers to the transfer of funds from the merchants' account within the gateway to their external bank account. Payout schedules and terms can vary based on the merchants' preferences and our policy. Merchants should be familiar with payout intervals and processing times.

  10. Service Downtime: Service downtime refers to periods when our payment gateway may not be accessible due to maintenance or technical issues. We strive to minimize any downtime and will provide advance notice when possible. Users should plan their transactions accordingly to avoid inconvenience.

  11. User Agreement: The user agreement is the comprehensive contract that customers accept when they create an account with our payment gateway. It includes all terms, policies, and conditions pertaining to the use of our services. By continuing to use our services, users agree to adhere to the updated versions of the user agreement.

  12. Dispute Resolution: Dispute resolution refers to the process by which disagreements or claims are resolved between users and the payment gateway, or between customers and merchants. These are governed by specific terms which outline cancellation policies and billing cycles. Users should understand the commitment they are making when subscribing to these services.

  15. Fraud Monitoring: Fraud monitoring involves the continuous surveillance of transactions to identify and prevent fraudulent activity. Our systems are designed to detect suspicious behavior and protect users against unauthorized transactions. However, users are also advised to monitor their accounts and report any unusual activities.

  16. Compliance: Compliance refers to the state of adhering to all applicable laws, regulations, and standards governing financial transactions and payment services. In order to utilize this payment gateway's services, users of this website are granted a limited, non-exclusive, and revocable license to access and use the content. It is prohibited to reproduce, distribute, modify, or use the content of this website without the owner's written consent. In the event of infringement of its intellectual property rights, we reserve the right to seek damages and injunctive relief in court.

An account held with our service is for the individual or entity's use only and sharing account credentials or allowing access to unauthorized users is against our fair use policy. All transactions must be conducted in a transparent manner, with accurate representation of goods or services, and in accordance with our anti-fraud measures. 

Our systems routinely monitor usage to detect and prevent misuse; as a user, you consent to such surveillance and agree to cooperate with any investigations relating to improper use of our services. Failure to adhere to these fair use guidelines may result in restricted access, suspension, or even permanent ban from our payment gateway and its associated services.

Indemnity 

You agree to indemnify, defend, and hold harmless Primasoft Technologies EST, its affiliates, partners, and their respective officers, directors, employees, agents, and successors from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use of our payment gateway, your violation of these Terms and Conditions, or your breach of any representation or warranty provided herein. The indemnification obligations include claims arising out of any unauthorized transactions processed through your payment gateway account, your negligent actions leading to loss or unauthorized disclosure of customer information, and any activity that violates applicable laws or regulations.

In the event of a claim requiring indemnification hereunder, Primasoft Technologies EST shall provide you with prompt notice of such claim and shall allow you to control the defense and settlement of the claim, provided that Primasoft Technologies EST may participate with counsel of its own choosing and that you shall not settle any claim without the Primasoft Technologies EST prior written consent. Your indemnification obligation under these Terms and Conditions is understood to be to the fullest extent permitted by law and shall not be construed to provide for indemnification that is otherwise prohibited or limited by law.

It is your responsibility to promptly notify Primasoft Technologies EST in writing of any legal actions, claims, or demands for which indemnity could be sought, including any investigation, claim, or lawsuit that alleges that the payment services provided have resulted in harm to a third party or violated any law. Your obligation to indemnify Primasoft Technologies EST shall survive the termination or expiration of your use of the payment gateway and the validity of these Terms and Conditions. 

Warranty 

Primasoft Technologies expressly disclaims all warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. Any services provided without charge are offered 'as is', without any warranty whatsoever, to the maximum extent permissible by law. In no event will the payment gateway be liable for any indirect, special, incidental, or consequential damages arising out of the inability to use the services, even if advised of the possibility of such damages.

Limitation of Liability 

Under no circumstances shall we be liable for any indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your use of our services, whether or not the damages were foreseeable and whether or not Primasoft Technologies was advised of the possibility of such damages. In no event will we be responsible for any failure or delay of performance. Primasoft Technologies assumes no liability or responsibility for any errors or omissions in the content of our services and does not endorse or assume any responsibility for any third-party content that may be accessed through the service. 

Severability 

If any provision of these Terms and Conditions is determined to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. In the event that any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect and, if possible, the invalidated provision will be modified in such a way as to reflect the original intent of Primasoft Technologies as closely as possible.

Force Majeure

In no event shall Primasoft Technologies be liable for any failure or delay in the performance of its obligations herein due to events beyond its reasonable control which may include, but not be limited to riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes. Upon the occurrence of a Force Majeure event, Primasoft Technologies is entitled to suspend the performance of its services until the situation is resolved or the event is over, without being deemed as a breach of its obligations.

Primasoft Technologies reserves the right to modify, amend or update the Terms and Conditions at any time and at our sole discretion, without prior notice.
